Dear user,

Below you will find the regulations for your use of the Website, both as a guest and a registered user. Your entry and use of the Website is treated as your unconditional consent to be bound by the following regulations and the provisions of the Privacy and Security Policy. The website is provided by RAWLPLUG SA with its registered office in Wrocław, ul. Kwidzyńska 6, 51-416 Wrocław, Poland ("Rawlplug") as a service to its current and potential customers and their employees, unless the content of the Website states otherwise. The Regulations apply to the benefit of Rawlplug and its subsidiaries and affiliates, i.e. the Rawlplug Group (see: Privacy and Security Policy).
Please read the Regulations carefully before using the Website. If you do not agree to its provisions, please leave the Site.
Agreeing to be bound by these Regulations means that you use the language in which they were prepared to the extent that you can fully understand them.

I. Definitions

Electronic Services marked services provided electronically via the Website or otherwise using means of distance communication by Rawlplug or its subsidiaries or affiliates in accordance with the General Terms and Conditions of Services available on the Website, other than making the Website available.

Agreement	
a marked agreement concluded via the Website between the user and Rawlplug, its subsidiaries or affiliates, the subject and content of which as well as other provisions result from the General Terms and Conditions of the Agreement available on the Website.

II. General provisions 
1. The Regulations regulate the use of the Website by users, the conclusion of contracts for the provision of Electronic Services or the provision of Electronic Services available through the Website, as well as the rules regarding the conclusion of Contracts.

2. Rawlplug is entitled to change the Regulations at any time. The change enters into force on the date of publication on the Website.

3. Access to the Website requires a working Internet connection and having a web browser or other application for viewing Internet content installed on a computer or other device used by the user. The User is responsible for taking all actions necessary to ensure access to the Website and ensures that all persons who have access to the Website through the user's Internet connection comply with the provisions of these Regulations. Use of some content on the Site may require you to have third-party software.

4.   Entering and using the Website constitutes the user's consent to be bound by the provisions of the Regulations. This consent means that you are either a) 16 years of age or older, or b) under 16 years of age and you are using the Website under the supervision of your parents or legal guardians who have agreed to be bound by the provisions of the Regulations on your behalf. If you are under 16 years of age and are not under the supervision of your parents or legal guardians, you are prohibited from using this Site. If you are the parent or legal guardian of a child under 16 years of age, you are fully responsible for the child's use of the Website, including any monetary obligations incurred by the child as well as other actions of the child that give rise to legal liability.

5. If Rawlplug determines that a child under 16 years of age has provided personal data through the Website, we will comply with the Privacy and Security Policy available on the Website.

III. Website Content

1. Through the Site, Rawlplug may provide users with the following content:
a) information about Rawlplug® products and services and other information and materials at Rawlplug's discretion;
b) information about Electronic Services provided via the Website or how to conclude contracts for the provision of Electronic Services;
c) concluding Agreements;
d) any other content at Rawlplug's sole discretion.

2. The content on the Site is provided for viewing and use in accordance with these Terms and Conditions, but does not necessarily reflect the opinions, representations or warranties of Rawlplug.

3. The content of the website may be deleted, changed, temporarily or permanently blocked, delayed or otherwise limited by Rawlplug at any time, at its sole discretion and without the need to inform the user, and regardless of the reason.

4. Unless otherwise indicated, most of the products and services displayed on the Site are available directly or indirectly from Rawlplug or the Rawlplug Group. Rawlplug will exercise reasonable care to ensure that the products and services displayed and their descriptions are accurate and correct.

5. Rawlplug does not provide any guarantees as to the correctness, availability or completeness of the content of the Website, in particular regarding prices, appearance, specifications, sizes, availability and accompanying services. The content of the Site may contain technical inaccuracies and typographical errors.

6. The Site may contain links to other websites so that you can obtain more information about the products or services available on the Site and other information. These links are provided as a convenience only and their presence on the Site does not mean that the website to which these links refer contains content provided by Rawlplug or Rawlplug Group companies, or that Rawlplug has any affiliation with the entities operating these websites.

7. The User and Rawlplug agree that Rawlplug and the companies of the Rawlplug Group are not responsible for the availability or content of websites linked to the Website.

8. Registration of a user account is not necessary to display the content of the Website. Electronic Services or concluding contracts for the provision of Electronic Services or Contracts may only be available to registered users.

9. Sending forms or any communication with Rawlplug via the Website requires your prior consent to be bound by the provisions of the Regulations by checking the appropriate "check-boxes" and clicking the "Send" or other similar button, as well as expressing other consents that Rawlplug may require, in particular, to be bound by the General Terms and Conditions of Electronic Services or the General Terms and Conditions of the Agreement.

10. Sending the form or any communication with Rawlplug via the Website does not lead to the conclusion of any contract, unless otherwise provided for in the General Terms and Conditions of Electronic Services or the General Terms and Conditions of the Agreement.

11. In the form or any communication with Rawlplug via the Website, the user is obliged to provide the information required by Rawlplug, including personal data, depending on the purpose of the given form or communication, in accordance with the instructions on the Website.

12. Rawlplug will maintain confidentiality and will not disclose to any third party any information provided by the user in the form or in any communication. However, Rawlplug may disclose this information if such an obligation results from applicable law or a final decision of a competent authority or a final court ruling, or if this information has become public. The obligation of confidentiality does not apply to the disclosure of information to employees or other persons involved in the provision of Electronic Services, performance of the Agreement or operation of the Website, including companies from the Rawlplug Group.

13. In the case of content available free of charge or Electronic Services provided free of charge or Agreements providing for free provision on the part of Rawlplug, Rawlplug may make the provision conditional on the user's consent to the processing of his or her personal data for marketing purposes related to the promotion of Rawlplug® products and services and receiving unsolicited information commercial electronically or by telephone by Rawlplug or entities from the Rawlplug Group. Consent may be withdrawn at any time. Expressing consent is not obligatory, but it prevents the provision of services.

IV. Registration

1. Access to some content of the Website may require the user to register a user account or register for access and therefore provide Rawlplug with certain information, including personal data. The User is obliged to provide true, complete and current information when registering a user account. Registration of a user account or registration of access is generally free of charge.

2. Registration of a user account may be made using an existing user account on other websites indicated by Rawlplug or through accounts with providers of other services. By selecting this registration method, the user authorizes Rawlplug to access this data and use it to register the user account.

3. Access registration is made each time and concerns one-time access to specific content of the Website without creating a user account.

4. If the user selects or provides a username, password or other information during registration, the user is obliged to treat this information as confidential information and not to disclose it to third parties. Your user account is a private account and you are not authorized to authorize other people to use your user account or provide any information related to your user account to such people. The User is obliged to immediately inform Rawlplug of any unauthorized login or access to the User Account.

5. The User is obliged to ensure that he or she logs out of the user account each time before closing the browser window or leaving the Website.

6. The User should exercise particular caution when logging in to the User Account in public places or via a public network or on a device belonging to a third party.

7. Rawlplug is entitled to deactivate access, user account, username or password, in the event of a request submitted by the user of a given user account or at any time at Rawlplug's discretion, without giving reasons, especially in the event of a user's violation of the provisions of the Regulations.

V. Rights and obligations of Rawlplug

1. Rawlplug is not responsible for the accuracy, availability and correctness of the information contained on the Website, as well as for (1) any unauthorized access to the servers on which the Website or the user's personal or financial information is located; or (2) any interruption or failure of data transmission to or from the Site; or (3) any viruses, Trojan horses, bugs or other programs or activities of a harmful nature that may be transmitted to or performed using the Site by any third party. Rawlplug is also not responsible for any websites linked to the Site; or (4) any harm caused by a DDOS attack or other malicious activity or content that may adversely affect your computer, software, data or other content of a confidential nature resulting from your use of the Site or any service available on On or through the Site, including downloaded files, as well as any website linked to on the Site. The above limitations are effective to the fullest extent possible and permissible by law, and in particular do not cover damages caused by the intentional actions of Rawlplug or its employees, or their gross negligence.

2. The User and Rawlplug agree that Rawlplug and entities from the Rawlplug Group shall not be liable in any way for any damage resulting from the User's use of the Website. Such limitation of liability is effective to the fullest extent possible and permissible by law, and in particular does not cover damages caused by the willful actions of Rawlplug or its employees or their gross negligence. This limitation of liability is subject to any other provisions of the General Terms and Conditions of Electronic Services or the General Terms and Conditions of the Agreement.

3. Rawlplug is not responsible for any disruptions during your use of the Website resulting from:
a) incorrect functioning of your web browser;
b) incorrect functioning of the Internet connection;
c) activities of third parties;
d) other reasons for which Rawlplug is not responsible.

4. Rawlplug is entitled to terminate the user's access to the Website in the event of:
a) violation by the user of the provisions of the Regulations;
b) violation by the user of the provisions of the General Terms and Conditions of Electronic Services or the General Terms and Conditions of the Agreement;
c) the user uses the Website in violation of the law.

5. Rawlplug is entitled to perform updates, repairs and maintenance works on the Website and technical infrastructure and temporarily block access to the Website for the time needed to carry out the work referred to above. Information about access blocking will be displayed on the Website.

6. Rawlplug is not obligated to acknowledge receipt of or respond to user communications sent to Rawlplug via the Site. Lack of confirmation does not give rise to any claims against Rawlplug for compensation for damage suffered by the user.
 
7. The content of the Website is for information purposes only and does not constitute an offer within the meaning of civil law. Any use, including reference to the content of the Website, is solely at the user's risk. Rawlplug is not responsible for any use of the content of the Site by you or any other person in any way.

8. Rawlplug has the right to contact the user by phone or e-mail in order to obtain further information from the user necessary to conclude an agreement for the provision of Electronic Services or the Agreement or provision of Electronic Services.

9. Rawlplug is also entitled to contact the user by e-mail in order to obtain an assessment of the Electronic Services or other content available on the Website.

VI. User rights and obligations

1. In communications between you and the Website, you are obliged to provide true, complete information, including personal data.

2. You undertake to repair the damage and indemnify Rawlplug, entities from the Rawlplug Group and their employees, contractors, proxies and members of bodies representing the company from liability for claims arising directly or indirectly from (1) your violation of the Regulations; or (2) claims for infringement or restriction of copyright, industrial property rights or other rights of third parties by User Content; or (3) your activities, including omissions, in connection with the Site.

3. The User is aware of the risks associated with using the Website and the Internet in general and assumes responsibility related thereto. The site and its contents are provided "as is" or "as available" without any warranty of any kind, whether implied or implied by law. To the fullest extent permitted by Rawlplug law, entities from the Rawlplug Group, their employees, contractors, proxies and members of bodies representing the company are not responsible for the Website provided.

4. The User undertakes, in particular, not to perform the following activities:

a) prevent or hinder other users from using the Website, in particular through "hacking" activities or activities leading to the destruction of the Website;
b) use the Website or its content for illegal purposes;
c) express or imply in your activity on the Website that it comes from Rawlplug or entities from the Rawlplug Group;
d) add or upload to the Website materials or information that are (i) protected by copyright or other intellectual property rights of third parties, protected by trade secrets or classified information, unless the user is authorized to undertake such activities; (ii) unlawful, obscene, defamatory, offensive, threatening, fraudulent, pornographic, stalking, inciting a crime, violating the principles of social coexistence and decency or violating the intellectual property rights of Rawlplug, Rawlplug Group entities or third parties or other rights; (iii) intended to victimize, harass or discriminate against individuals or groups based on age, disability, national origin, religion, race, gender or sexual orientation; or (iv) not disclosed to the public and concern a natural person or a legal person, without the appropriate authorization of that person;
e) engage in spamming, flooding, phishing or other activities aimed at illegally collecting information;
f) transmit software or other materials containing harmful code, including viruses, Trojan horses and others;
g) modify, adapt, sublicense, translate, sell, reprogram, decompile or disassemble any part of the Site;
h) remove any indication of legal protection, including copyright and trademark protection, contained on the Website;
i) use "framing" or "mirroring" of the Site without Rawlplug's written consent;
j) collect information about visitors to the Website;
k) use the Website in a way that may cause damage to Rawlplug or violate the interests of Rawlplug or entities from the Rawlplug Group;
l) impersonate Rawlplug or a Rawlplug employee, another user, or any person or entity (including by using similar email addresses or names associated with such person or entity);
m) send or cause the sending of any advertising or promotional information, including spam, the so-called chain letters or other similar activities.
n) take any other action that restricts or prevents the use of the Website by other persons, or, in the opinion of Rawlplug, may cause damage to Rawlplug or other persons or expose them to liability.

VII. Personal data protection

The processing of personal data and the protection of personal data takes place on the principles described in the Privacy and Security Policy [link].

VIII. Intellectual property rights

1. All software, content and functionalities of the Website (including, in particular, information, texts, presentations, images, videos and sounds, the design, selection and arrangement of these elements), including texts, graphics, logos, icons, images, audio clips and video and software are the property of Rawlplug or are the subject of a license granted to Rawlplug and may be subject to protection by international copyright, trademark protection, patent, trade secret or other intellectual property right.

2. These Regulations authorize the user to use the Website only for personal purposes and not for business purposes. However, you may not under any circumstances reproduce, copy, distribute, publish, download, store or transmit any content of the Site, except:

a) temporary storage of a copy of this content by the user's device in connection with the user's entry and use of the Website.
b) automatic storage of files obtained by a web browser in order to increase the comfort of using the Website;
c) downloading and printing one copy of the Website's subpages by the user for personal use, unrelated to business activity, without the possibility of further reproduction, publication or distribution;
-unless the General Terms and Conditions of Electronic Services or the General Terms and Conditions of the Agreement provide otherwise.

3. In particular, the User may not:

a) modify copies of any content of the Site;
b) use graphics, photographs, films or sound sequences without any connection with the text to which they appear;
c) remove or change any indication of protection of a given content by copyright, trademark registration or other intellectual property rights on copies of the Website's content.

4. If a user prints, modifies, copies or allows another person access to the Website or otherwise uses the Website in violation of these Regulations, he or she loses the right to use the Website and must return Rawlplug or destroy any copies of the content. located on the Website.

5. No rights in or to the Site or its contents are transferred to you, and all rights not expressly granted to you remain with Rawlplug. Using the Website in a manner other than that described in these Regulations constitutes a breach of the Regulations and may constitute a violation of copyright, trademark protection rights or other rights.

6. The collection (in the sense of selection, arrangement and combination) of the content on the Website is the exclusive property of Rawlplug or entities from the Rawlplug Group and is protected by copyright.

7. The Website may contain additional information about rights regarding individual contents of the Website, the terms of which must be complied with by the user.

8. Names, trade names, logos, service marks, trademarks, so-called tradedress are unregistered or registered trademarks of Koelner Rawlplug IP sp. z o. o. based in Wrocław or other entities from the Rawlplug Group.

IX. User-generated content

1. While using the Website, the user may have the opportunity to post comments, opinions, texts or ideas on the Website; send messages to Rawlplug or other users; post audio files or videos; or provide various other content to the Site ("User Content"). The User agrees that such User Content will be publicly available and does not stipulate that the User Content will be private, confidential or protected by law. In exchange for free access and use of the Website, the User grants Rawlplug and entities from the Rawlplug Group an irrevocable, free and territorially unlimited, non-exclusive license to use the User Content and dispose of it in any way, including in particular dissemination, publishing, reproduction, multiplication , displaying, placing on the market, deleting and copying regardless of the form and type of medium. You irrevocably consent to Rawlplug creating, using and disposing of User Content ("User License").

2. The User consents to the User's Content being published on other websites of Rawlplug or the Rawlplug Group. The User undertakes not to exercise his/her moral rights against Rawlplug and Rawlplug Group entities and consents to Rawlplug or Rawlplug Group entities making any changes or modifications to the User Content.

3. The User guarantees that he will not mislead Rawlplug or other users of the Website, in particular through the information or data entered, as to the origin of the User Content.

4. By entering User Content, the user ensures and declares that he/she has full rights to this User Content on an exclusive basis, has the right to grant a User License in accordance with the above provisions and that the User Content does not infringe any rights of third parties. The User undertakes not to enter User Content containing an image, personal data, voice or other features characteristic of a third party without the consent of that person. The User's Content will not violate any other provisions of the Regulations.

5. If the User Content contains the image, personal data, voice or other characteristic features of the user, by entering this User Content on the Website, the User expresses irrevocable consent to the use of this information by Rawlplug as part of its business activities, without time and territorial limitations, unless the permissibility withdrawal of consent results from generally applicable provisions.

6. Rawlplug reserves the right to remove any User Content from the Site without notice or justification and at its sole discretion. However, Rawlplug is not obliged to monitor the content of the Website.

7. The User is fully legally responsible for the User Content, in particular for its legality, reliability and truthfulness.

X. Final provisions

1. Complaints should be submitted within 7 days of the problem occurring - in electronic form to the email address: technical.helpdesk@rawlplug.com or by post to the Rawlplug address.

2. A properly submitted complaint should contain the following data: user's name and surname, name (if applicable) and description of the problem that is the basis for submitting the complaint. This includes, among others, the date and type of irregularity.

3. The complaint will be considered within 14 business days from the date of submission of the complaint.

4. Disputes between consumers and Rawlplug are not subject to out-of-court resolution of disputes with consumers.

5. Any individual and additional arrangements between Rawlplug and the user must be in a documented form under pain of nullity, unless the Regulations clearly provide otherwise.

6. If any provision of these Terms and Conditions is invalid or ineffective as to the user, you agree that such provision will be replaced by a valid or effective provision that best reflects the original intention of the parties, and together with the rest of the Terms and Conditions will govern your use of the website. user.

7. The provisions of Polish law will apply to these Regulations.

8. All disputes related to these Regulations shall be subject to the exclusive jurisdiction of the Polish courts competent for the registered office of Rawlplug, unless otherwise provided for by generally applicable law.
